Your Social Security Attorneys for Radcliff, Hardin County, and Surrounding Areas

When you are too disabled to work, you may not know where to turn or how to provide for yourself and your family. Fortunately, help is available.

The Social Security Administration (SSA) provides disability benefits through two different benefits programs: Social Security Disability Insurance (SSDI) and Supplemental Security Income (SSI).

Although Social Security Disability benefits are supposed to be a lifeline to people who are disabled, qualifying for benefits is very difficult because the SSA is extremely concerned with preventing fraud.  The result is that many legitimate applications are denied, leaving people without the benefits they need. A Radcliff and Elizabethtown and Louisville SSI lawyer at Musselwhite Staples Hafley & Johnson can help you have the very best chance of getting benefits. Our attorneys can represent you when applying for SSI, or if your claim has been denied and you need to appeal. Qualifying for Social Security Disability Benefits

SSDI is a program for people who have worked for a long period of time and earned work credits before becoming disabled. SSI, on the other hand, is a means tested program. The program is limited to people who have few family resources and who have low or no incomes.   You will need to determine if you qualify based on financial limitations in your family in order to apply for SSI benefits.

If you meet the basic requirements, then you’ll need to prove you are severely disabled with a long-term condition in order to get benefits. This is the most difficult aspect of applying for Social Security Disability.  The SSA has a really narrow definition of disabled and you will need solid medical proof to show that you are completely unable to work before your benefits claim will be approved.

The SSA has a “Blue Book” or Listing of Impairments usually considered sufficiently severe to make you eligible for benefits. When applying for disability income, you need to check if your condition is listed. If it is, you must be able to show you have specific symptoms that the SSA requires for that condition.  If you cannot prove you have these symptoms or if your medical problem isn’t listed, you’ll need to prove your illness or injury is just as severe and makes it impossible to have a job.

If the Social Security Administration decides you are sufficiently disabled and cannot work, then your benefits claim will be approved. If your claim is denied, on the other hand, you have the option to appeal.  There are four stages of appealing a denial, and a Kentucky SSI lawyer at Musselwhite Staples Hafley & Johnson can guide you every step of the way.
