7 Questions to Ask Your Divorce Attorney
Are you considering a divorce? Have you and your spouse separated but you do not know what to do now? If so, we want to help. Our divorce attorney can answer all of your questions regarding divorces in Kentucky, child support, child custody, property division, and alimony. Below are common questions that most people have when meeting with a divorce attorney.
-
Is divorce law your specialty?
When you are going through a divorce, you want an attorney who understands Kentucky divorce laws and who has extensive experience representing clients in family court. There are attorneys who claim to be a divorce attorney who barely have any experience at all. Ask the attorney how long he has been practicing in the area of family law and how many divorces he handles each year.
-
How long does it take you to return telephone calls?
Good communication is essential in a divorce case. You want to make sure that you will be able to contact your attorney in case of an emergency such as your spouse not returning your children as scheduled or coming into the marital home after the court has awarded you the temporary right to reside in the marital home. A good attorney will usually return your call within 24 hours. If possible, our office returns telephone calls the same day unless the attorney is in court or out of the office on another matter. Because our attorneys are sometimes engaged and unable to immediately return telephone calls, we have an experienced, highly-trained staff available at all times who can handle many matters until an attorney is available.
-
Will another person be working on my case?
As discussed above, we have a dedicated staff of legal professionals who assist our attorneys with cases. You will meet each person working on your case and, even though you will be working with other staff members, our attorneys personally take charge of your case and supervise every step that is taken in your case. You will not be transferred to a paralegal or associate attorney and only see the attorney handling your case in court. You will have access to your attorney at all times during your case.
-
What are your billing procedures?
A divorce attorney can bill by the hour or charge a set fee. You need to understand how the attorney will bill for your case, what costs the attorney will bill in addition to his or her fees, and if the attorney will require a retainer fee up front. During your initial consultation, we discuss our fee schedule in detail so you understand our fee structure before you retain our office.
-
How much do you estimate my divorce case will cost?
An honest divorce attorney will tell you that it is difficult to give you an exact estimate because the fee greatly depends on the level of conflict in your case. If a divorce is uncontested, it will cost less than a divorce that involves litigation. Beware of attorneys who quote an unrealistically low fee simply to get you to retain the law firm.
-
Based on our discussion, what is your strategy for my case?
An experienced divorce attorney should be able to provide you with an initial opinion of how you should proceed with your divorce based on the facts you present during your consultation. This strategy may change if the circumstances change; however, you should leave the consultation with a concrete explanation of what the attorney recommends and why.
-
What is your overall style or philosophy when handling a divorce?
One of the most important things you need to consider when choosing a divorce attorney is whether you feel comfortable with the attorney and you feel like you can trust the attorney. Your divorce attorney will be guiding you through one of the most difficult life events you will face. Ending a marriage is never easy even when both parties agree to an uncontested divorce. You want to ensure that the divorce attorney you choose shares the same overall philosophy as you do about how to approach a divorce.
